Wisconsin Act 192 (formerly Senate Bill SB190) was signed into law on April 21, 2010 with date of publication being May 5, 2010. Act 192 addresses Automatic Contract Renewals and becomes effective June 1 2010.

History on Act 192;

  • We met with the legislative Assistant of Senator Wirch, the bill’s author, and attempted to have language inserted which would have exempted Fire Alarm and Security contracts. The request was ‘brushed aside’ because the benefits of our exemption request are weighted to the seller and not the consumer. “The bills primary objective is to protect the consumer from aggressive and unscrupulous contract language” per Senator Wirch.
  • Any contract over $250,000 is exempt
  • All existing agreements are exempt.
  • The bill is strictly for Business to Business activity. The bill does NOT apply to residential contracts.

The original contract length is not affected by this bill. Original contracts can be of any term length. This bill affects the renewal after the initial agreement term has expired. This was confirmed by Wisconsin Legislative Review Attorney, Mary Matthias.
